Two brothers and their mother have been formally charged in the case last week in which they were accused of doling out punishment to an alleged trespasser intent on stealing their marijuana.
Brothers Lazarus, 35, and Juan Pino, 22, have been charged with first-degree murder, second-degree kidnapping, first-degree assault with a deadly weapon, aggravated robbery and felony menacing. Their mother, Pamela Pino, 57, was charged with second-degree kidnapping in connection with the incident Sept. 26 when a Wyoming man jumped their fence in Hereford in an apparent effort to steal marijuana.
All are in Weld County Jail in lieu of posting $500,000 bonds.
Lazarus and Juan Pino, according to a Weld sheriff affidavit, tied the man to a tree, beat him and tortured him, before making him make a video confession then driving him home.
The man later returned to the property with a friend to retrieve his vehicle, at which time the brothers apparently chased them off the property, firing one shot that landed in the cab of the pickup.
In an arrest affidavit, Pamela Pino told investigators she heard one of her sons yelling, Who sent you here? after the brothers caught a trespasser about 3 a.m. Sept. 26. She said she recognized the man, Craig McFarlin of Carpenter, Wyo., as someone she had last seen 15 years ago. She said the boys roughed him up a bit, and she told them to stop and told them to drive McFarlin home. They were arrested Sept. 30 when sheriffs deputies and SWAT team members served them with arrest warrants.
The three have set court dates for bond reduction hearings in the coming weeks.
